1. Acceptance of these Terms

These Terms and Conditions ("Terms") govern your access to and use of the Surfaced Social mobile application and the website surfacedsocial.com (together, the "Service"), operated by Wahyd Group Inc. ("Surfaced Social", "we", "us"). By creating an account, downloading the app, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Surfaced Social, or the minimum age of digital consent in your country if it is higher. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. We may require proof of age and may suspend accounts that do not meet these requirements.

3. Your account

You are responsible for the activity that happens on or through your account. Keep your password secure and notify us immediately at info@surfacedsocial.com if you believe your account has been compromised. You may not sell, transfer, or license your account, impersonate another person, or create accounts through automated means.

4. Your content and license to us

You retain ownership of the content you post on Surfaced Social, including articles, links, updates, Stories, comments, and profile information ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating, promoting, and improving the Service. This license ends when you delete your content or your account, except where content has been shared with others who have not deleted it, or where retention is required by law.

You represent that you have the rights necessary to post your User Content and that it does not infringe the rights of any third party.

5. Acceptable use

You agree not to use the Service to:

• Post content that violates our Community Guidelines, including illegal content, harassment, hate speech, sexual content involving minors, or incitement to violence
• Infringe intellectual property, privacy, or publicity rights
• Distribute spam, malware, or deceptive links
• Scrape, harvest, or collect data about other users without consent
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems
• Misrepresent your identity or affiliation

6. Moderation and enforcement

We enforce our rules transparently. If your content is removed or your account is restricted, we will tell you what happened and why, and you can appeal the decision. We do not practice shadow banning: if your post breaks the rules, you'll know; if it doesn't, it stays up. Major enforcement decisions such as suspensions and bans are reviewed by human moderators. 7. Intellectual property

The Service, including the Surfaced Social name, logo, design, and software, is owned by Wahyd Group Inc. and protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights in the Service. If you believe content on Surfaced Social infringes your copyright, contact info@surfacedsocial.com with details of the work, the allegedly infringing material, and your contact information.

8. Third-party content and links

Surfaced Social surfaces news and content from third-party sources across the political and creative spectrum. We do not endorse, and are not responsible for, third-party content, websites, or services linked from the Service. Accessing them is at your own risk and subject to their own terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate or reliable.

10. Limitation of liability

To the maximum extent permitted by law, Wahyd Group Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of one hundred US dollars (USD 100) or the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Wahyd Group Inc. from any claims, damages, and expenses, including reasonable legal fees, arising from your User Content, your use of the Service, or your violation of these Terms or the rights of any third party.

12. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or our Community Guidelines, or if required by law. Sections that by their nature should survive termination, including content licenses for retained content, disclaimers, limitations of liability, and indemnification, will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we make significant changes, we will post a notice on Surfaced Social, email registered users, and update the effective date at the top of this page. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Nassau County, New York, unless applicable law requires otherwise.
